There are Times When Workers Can Go Beyond Worker' Compensation and Sue Employers for Injuries

Workers who have been injured on the job in Georgia may sometimes go beyond workers' compensation benefits and sue employers for injuries related to work.


    MACON, GA, June 09, 2021 -- Attorney David Mann of the Mann Law Firm, announced today that workers who have gotten injured at work usually are covered by Georgia workers' compensation benefits, but in some situations, they may be able to sue their employer and receive additional compensation.

"While Georgia's workers' compensation law provides employees who are injured or contract illnesses on the job with a way to receive payment for lost wages and medical expenses related to the injury, a lawsuit may bring additional compensation."

He notes that Georgia law requires that every employer with three or more workers must carry workers' compensation insurance. However, workers' comp only provides a percentage of wages and may not be enough to cover an injured worker's needs. In addition, employers and their insurers who are out for profit often try to deny claims or pay out as little as possible.

If you qualify for, file for, and accept workers' compensation, Mann says you are not allowed to sue your employer even if their negligence caused the accident. However, there are certain situations where you can file a lawsuit for the injuries you suffered.

"While workers' compensation can provide benefits for your medical care and lost wages, a successful lawsuit can provide an award, called damages, for both compensatory damages and punitive damages," says Mann.

In Georgia, compensatory damages include both general and special damages. Special damages are for monetary losses, such as medical and rehabilitative expenses, lost income from being unable to work, and property damage. General damages are for losses that do not have a specific dollar value, such as past and future pain and suffering.

If a workplace injury results in death, a wrongful death lawsuit may provide an award for survivors that may include restitution for potential lifetime earnings of the deceased and loss of companionship.

In some rare cases, such as where there is willful misconduct, malice, or fraud, punitive damages may also be awarded. The purpose is to punish a defendant and deter such behavior in the future.

Damage award amounts can vary greatly, depending on circumstances such as the severity and permanence of the victim's injuries, and the negligence, insurance coverage, and available assets of the defendants.
